suing someone in small claims court who is out of the country
Can I sue someone in small claims court who is out of the country for three months? I have a promissory note that is past due (February 2009) and have yet to be paid.

You have to serve them, and if they are out of the country, that's going to prove difficult. Check with the Small Claims Clerk about how to serve someone who is not available - they can tell you what your options are.
