Legal Question in Credit and Debt Law in California

Summons - Civil Judgment

Summons for civil judgment was left on the door. No one was at home to receive summons. Should this be served in person? Does this mean that I was officially served?

Thanks,

Ann

Typically, process servers will do things they're not supposed to do. You can go to court to fight the service. So they'll just serve you while in court or at some other inopportune time. Please let me know if I may be of assistance in defending you. You will have 30 days from the date of your receipt to file the appropriate response with the court.

Although most process servers are ethical and follow the law, nothing would prevent them from lying about serving you. In order to avoid having a default judgment taken against you, consult an attorney and find out the proper legal response to a case of this nature. If it is an eviction lawsuit, you could have as little as 5 days to respond.
