Summons for Credit Card Debt
I have been served a summons for an unpaid credit card debt. I must answer but cannot locate a form. Can I just write a letter to the court stating my side of the case?

That said, you should definitely consider visiting an attorney to discuss the merits of the case and decide how to proceed. Also, if you have any cross-claims against the credit card company, you'll have to file a cross-complaint at the same time that you file your answer.

There are several defenses that can be raised, including statute of limitation. Also, I've had reasonable success in either negotiating a lesser amount or having similar cases dismissed. Feel free to contact me directly with details.
