The collection firm wants you to ignore the lawsuit; in fact they depend on it. Fight back and defend yourself. Just don�t be surprised how quickly they fold (don�t worry -- we won�t remind you we told you so).

You hire a lawyer now, with enough time to retain him, have him prepare, and to respond within 30 days of service (if it is civil) otherwise you may lose all your rights.

1. Do nothing for 16 more days and lose the case by default. Or,
2. Consult a lawyer.

You need to file an answer or have an attorney file an answer for you or you will default and lose your rights to defend the action.
These credit card and debt buyer cases are filed regularly with the hope that the consumer will default. About 98% do. They are defensible.

You must file a responsive pleading within 30 days of service, either a Motion, an Answer or a General Objection and Affirmative Defenses, depending on the facts. You may also wish to present this to your insurance company, if applicable.
