Legal Question in Credit and Debt Law in California
Time Factor on Business sending out billing for service rendered.
We own a Septic Pumping business and when allowed do disposals at a wastewater treatment plant. We fill out a form to show company info.and gallons disposed, they also have a computer number they give us that its automatically put into there system, but has'nt worked. Most WWTPs send out a monthly bill, but we have not recieved one from this one after 8 months. At couple hundred a load, its added up.What's our rights if anytime or a year from now we recieve a heafty bill from them for payment? The billing for this WWTP comes from a different Corp.also if this matters.Dont know if they dont care if other company gets paid,or someone is slacking on job! Also all our forms for disposals are still on clipboard at disposal site wall!
Thank You!!

You are still responsible even they are negligent by failing to send out your bills. I would not let this drag on, because you never know when those bills will finally catch up with you. They might not let you dump their anymore if they suddenly decide your account is past due and you can't come up with the money. I would get with their accouting manager right away to arrange a repayment plan.
I once had a condominium association as a client that had a similar problem. It was built in the 1970's and had 24 water meters. Somehow, 3 of the meters were never registered in the water department's computer. When this and other similar stories hit the news, the water department suddenly wanted more than $400,000 and shut off the 3 meters in question. I got a court order forcing them to turn the water back on while sorting things out. The HOA eventually paid 3 years of bills. Contact me and I will email you a copy of the story.
