Unfair

In 2001 I owed some money to unemployment for overpayment and started paying and then fell into some finanical trouble. And could not pay so in 2002 moved to Ny then moved back and then did not have a job so I filed for unemployment and because of the back paya that I owed I wa penalized. So last year I moved again from Sacramento to Bakersfield to get married and found out lat thrusday that they attached a wage attachment and I did not find out they had done this until it was already in process sinced I moved I got no papers to let me know what was going on and once I called they would not let me do anything at all I do not make that much at all because I have bills and my husband is on disability what can I do.

In any wage garnishment situation, either you or the levying officer has the duty to provide you with notice of the garnishment. Those papers should provide you with instructions on how to file a claim of exemption so that you can reduce or eliminate amount garnished. Contact your human resources department to get copies of the papers that were served on your employer to start the garnishment and follow the instructions to submit a claim of exemption.
