Legal Question in Credit and Debt Law in California

Unknown debt referred to collection agency

It's a long story but basically I signed a contract with a company for use of a ''server''per the request of a cmpany that I had contracted with to do e-mail advertising.. I was under the impression that I could cancle at any time. I only needed it for a day. Well, as soon as teh marketing guy began sending out the eimailads I got a call fro teh ''server'' cmpany,Verio saying they shut em down for ''spam''. At that time I didn't know what that meant but called the marketing guy and he saidn ''it's not spam''. Needless to say I never got my e-mail ads from teh marketing company and am out $675 with them but what is worse is that I got an e-mail a month after this from Verio about an on line statement which I was unable to view because it required a ID and password which I knew nothing about.. I called them right away and told them I was shut down and don't have an account and they said they would take care of it. After calling every month and someone assuring me it was being taken care of finally someone said they couldn't find an account for me. I though it had been closed. It has been referred to a collection agency and it is in the amount of $3054! I never got anything. It was used for about 15 minutes. I was told I was shut down

Re: Unknown debt referred to collection agency

Let's dissect your question one item at a time.

You decided to do marketing by sending out unsolicited emails, but you didn't think it was "spam."

You signed a contract with a company but, because you did not read it, you were "under the impression" you could cancel.

The company you hired to spam people ripped you off.

Then, you became aware you still had a server account. You called them, you told them, they said, you called every month, they assured you, someone said, you were told.

But you never wrote them a letter, so none of the calling and telling and being told and being reassured means squat.

You owe them $3054.
