unpaid down payment on new car

If they ar suing me for an unpaid balance, but they cashed the check that had paid in full in the memo section do I still have to pay the balance.

You still owe the money if there is a contract for the purchase of the vehicle, and it specified a down payment greater than what you paid to date. Simply writing "paid in full" on the check's memo line isn't going to cut it.
