Legal Question in Credit and Debt Law in California

vehicle reposession

GMAC repo'd my cars on June 22nd 2007. My payment was origionally due on May 8th and June 8th. I spoke with their financial center which stated I had till the end of June 22nd to pay. The car was take at 2am on the day in question. What laws or statutes can I use to obtain my car since it was not past 60 days late and I live in California?

Unless the loan documents you signed allow your payments to be late for 60 days, you are pobably out of luck. Generally a lender can reposses their vehicle any time after the due date. The fact that you spoke to someone at GMAC makes no difference, and the only way you would be able to rely on the statements made by the financial center would be if they were made in writing and signed by an authorized representative of GMAC.

They do not need to wait 60 days to repossess your vehicle. Once you are late, they can do that. You were more than 30 days late and they still gave you another 15 days approximately.
