Legal Question in Credit and Debt Law in California

Vehicle Repossession

I was driving a vehicle registered to my son who lives in a city 60 miles away. While I was at church, during the church service the vehicle was repossessed and taken from the Church's parking lot. Is that legal and/or does that constitue a Breach of the Peace?

Re: Vehicle Repossession

There is nothing specifically illegal about repossessing a vehicle from a church parking lot or during a service. You also haven't described any breach of the peace.

The repo agent must retrieve the vehicle in a peaceful manner. From your description, this was a clandestine operation. The was no angry confronation, argument or fight that you have disclosed. It might be rude and inconvenient, but not illegal based on your description.
