Legal Question in Credit and Debt Law in California
victim of practical joke
Hello,
a couple of months ago I started to receive magazine's in the mail addressed to me and I never subscribed to them. Then I started to recieve books and merchandise from an online company. I had my suspicions on who was doing this and it came true when I got a post card back in the mail ordering 10 more magazines in this persons handwriting but the forgot postage when they mailed it. I contacted the sheriffs department they wouldnt give me a crime report advised me to call the companys and get more info. I recieved some origional post cards ( the ones that slip out of magazines to fill out and mail) all in this guys writing. I went back to the sheriffs dept, post office, postal inspector etc, still cant get a crime report. I then recieved a package in the mail with this man's first name on it and my last name, his mistake. To date I ''owe'' over $ 2435.86 and they keep coming. The sheriffs said even though I know who's doing this because they haven't ''gained'' from this ''joke'' he hasn't broken the law. What can I do to stop this harassment, be relieved of these credit bills, have him charged? Isn't it fraud? why cant they help me?

Demand that the sheriff file a report for Identity Theft and give you a copy. Under Penal Code Section 530.5, the sheriff -must- take the report and give you a copy. If they still won't take the report, ask to speak to a supervisor. Maybe after you file this report, they will take this matter seriously. You could also call the California Attorney General Identity Theft Hotline at (8 88) 8 80-0 240.
And then sue the *******.
