Legal Question in Credit and Debt Law in California

Volunteer repossesion

I bought a car more than one year ago, with payments to do monthly, but now the car keeps breaking down all the times with different problems, (it is a Ford Focus 2000). So I want to have it repossesed volunteerly. But I don't know what is the procedure to follow. I know I can break the contract and have it repossesed after a year from the purchase. Can anybody tell me how I should proceed from now/ the car is a lemon, but I cannot show it legally, because it never broke down 3 times for the same problem. Please help me.

Re: Volunteer repossesion

The auto manufacturers do not like to take back cars after they sell them. Attempting to negotiate your way out of the contract is possible, but you may run into resistance. However, maybe the car is a lemon as defined by the lemon law. There is some straight forward criteria defining a lemon under the statute. I also have heard about problems with the Focus and maybe there is a recall related to your car you are not aware of. Go ahead and look it up or if you would like to follow-up with me feel free to do so-Martin
