Legal Question in Credit and Debt Law in California

wage garnishment

If I owe a balance to a child care facility and am unable to pay the whole amount at this time and they sold it to a recovery agency. Can the recovery agency sue me and garnish my wages? I do not own a home or car they did threaten me with saving they can seize my wedding ring and stuff like this to satisfy my debt. Can I offer to make payments on the account My total debt is 4400 I can only pay 100 per month does that sound unreasonable?

Re: wage garnishment

Thank you for your posting. Any balance owed you can be sued for. If you don't answer, and they win by default, or if they prove the case against you at trial, you may have a judgment against you, which they can collect in a variety of ways, including garnishing wages.

You can offer to pay whatever you can afford, but it is not up to me to decide if that will be accepted ... the only entity that can say yes or no is the creditor.

Best of luck, and please email or call if you have any other questions.
