Wage Garnishment

Is there anyway I can reduce a garnishment of my pay check, to less than 25%. Who would I contact?

Re: Wage Garnishment

Possibly, either thru hardship considerations by the court or successful negotiations with the creditor at issue. Our Law Firm may be able to help you with one or the other, upon your direct request hereafter.

Re: Wage Garnishment

You can file a Claim of Exemption (Form WG-006) and a Financial Statement (Form WG-007) with the Sheriff's Department to claim you wages as exemption. The form allows you to specify a lower amount to be withheld from your check or claim the entire check as exempt.

Once you file the paperwork with the Sheriff, the Sheriff notifies the judgment creditor. If the judgment creditor does nothing, then the Sheriff will modify the earnings withholding order. If the creditor objects, the court will schedule a hearing to determine how much should be withheld from your paycheck.

You can also try to negotiate with the creditor and you might also consider bankruptcy as well.
