Legal Question in Credit and Debt Law in California
Will I gain my future husbands child support debts
1 Answer from Attorneys
Not if you and he plan carefully. It also depends on whether you mean unpaid support arrearages or just the ongoing obligation. If he is current on his obligations and continues to pay as required, your income and assets will never be attached for the debt. Also your income is included in support calculations only to the extent it affects his taxes and withholding. It is not counted as money available for support. If he is in arrears or falls behind, however it gets more complicated. Any money or assets he has a right to access can be reached to pay the back support. So all joint accounts and any jointly held assets are fair game for collection of the debt. Your separate property, however, and your share of community property held only in your name cannot be reached, unless you try hiding his money or assets by putting them in your name only to evade paying.
