Writing a complaint for limited civil lawsuit (monies owed on account)
I am doing some paralegal work for a business who wants to file a limited civil lawsuit in the Superior Court of California, Santa Clara County. In the summons and complaint documents, on the complaint in section two I stated Defentdent owes plaintiff the amount of $$$, according to the account hereto annexed as Exibit A. Just to clarify is this correct and is there any other statement or explanation why monies are owed required? If so how would I properly conclude my complaint. I know this is a few different questions regarding the proper procedure of writing and effective complaint. If you only answer one question I thank you and If you answer all, I thank you much. I CAN ANSWER MOST OF YOUR QUESTIONS WITH FREE CONSULTATION. PLEASE CALL ME. Normally, you only have to generally plead causes of action if you are using the judicial council forms.

Sounds as if you are practicing law without a license.

A recent law requires you to be working under the supervision of an attorney. I would suggest that the company that you are involved with find a local attorney to represent them.
In the mean time, you should cease this kind of activity. You are practicing law without a license to do so, and can be subjected to severe penalties, as can the company you are working for.

You are not supposed to be writing a complaint unless you are under the supervision of a lawyer because that is practicing law without a license. We cannot answer your question because it is against the law for us to assist you in breaking the law. it is also illegal for a corporation to file a legal pleading if they are not represented by a lawyer.
