Legal Question in Credit and Debt Law in California

A written contract was signed by the debtor to pay a personal loan of $1,000 back in October of 2010. The debt has still not been paid back several phone calls have been made to this person but he does not pick up the phone and now there is a for sale sign at his home and apparently he has moved within the last couple of days. What action should be taken now? Can a lien be put on his house if the amount of the loan is under $1,000?

You can sue in Small Claims and get a judgment and then file an Abstract of Judgment with the County Recorder's Office. That will be a lien on all real estate the person owns in the County where you file the Abstract of Judgment.
