wrongful charge now in collection

Last year I used a moving company to move my small office from one building to another building about 1/4 mile away. I was quoted $260 and subsequently charged $460. During the move, one of two matching 4-drawer filing cabinets was dropped and wrecked (drawers don't open, smashed front). They offered to replace one cabinet but not two that match. Plus they charged excessive amount for the small office move. I refused to pay the bill and now the company has sent it to collection. Can I sue them in small claims?

Licensed moves in California use a contract. What did your contract say about the price? Also, what did it say about damage? Normally, damaged items are paid on a per pound basis. They are probably not required to pay you for the matching cabinets.

Basically, you need to read your contract. Find out what the cost was in the contract and what it says about paying for damaged property.
