Wrong,invalid name on summons!
I just received a summons for an outstanding debt from 2004. It states that I owe them $X amount and they filed on August 28th 2008 and the date of the breach was Sept 28, 2004. Now here here is the good part. They did not list the account number of the supposed debt. nor was my legal name listed. I was listed with the porper first name but did not list my last name, instead the used ''Jr Jr'' as my last name. I am named after my father so hence the ''Jr'' part. What can be done about this? I know that I have some debt still floating out there and I am amaking ammends to pay everything back.

If you were served, you have to respond within 30 days. In the interim, you might check your free credit report to determine what debt it might be. You might have some defenses, including statute of limitations and it's not your debt. In addition, it's possible the plaintiff might not have any of the necessary paperwork to prove its case, but that you'll know down the road. Don't let the 30 days slide, though.
