Legal Question in Credit and Debt Law in California
I have a young friend who has just received a summons, regarding non payment on a credit card. I contacted the attorney representing the credit card co. and they said with a 5800.00 bal and fees of 1300, the bal was at 7100. I asked what they would except as pay off and they want us to make the offer. Or they would except 1700 with payments of 180 per month. Unfortunately my friend has only just found a job, and is working 2 days a week at this time. Up to now the Co. he was going to work for never opened their doors and he has been left scrambling to find odd jobs. He is trying to find more work, and is enrolled in college. I can't see looking at his monthly income how he can afford 180.00 per month, on top of his insurance, car payment and food. At this time I have put a roof over his head for free, he has no where to go. please let me know how I can help him, I myself don't have the 7100.00 the most I can offer is 1600.

Aside from the fact that you appear to be practicing law without a license, what would be wrong with allowing little Johnny to deal with the credit card company himself? He borrowed the money at 20% interest or whatever, he's a grown-up, let him solve his own problems and deal with the consequences of his own foolishness. Let him hire his own lawyer if he has to. Otherwise how is he supposed to learn. And why are you providing him with a roof over his head.
