Legal Question in Criminal Law in California

is 487a a strike in California...it is being put as a felony but it was a commercial property that we were told closed down well over a year ago and the items were outside behind a gate but the gate had no locks, i had no tools to break in...didnt cause any violence and when the police showed up i cooperated because i didnt think i was stealing anything but it turns out the guy was mistaken and the company was open or had opened back up im not sure but i dont want a strike

No. The charge is not a strike. Its a wobbler, which means it can be, either a Felony or a misdemeanor, depending on the facts of the case, and the negotiations of your attorney. Hopefully you have a very good lawyer. On the facts you speak of, with the right negotiations, it could be a misdemeanor. You DON'T want a FELONY, if you can avoid it. A FELONY is a life-changer.
