Legal Question in Criminal Law in California
48-hour Probable Cause Hearing Violation
Is there a remedy for a violation of California Penal Code section 825? If so, is there case law to back it up. I have been searching for a week and I have found People v. Jenkins (2004) 122 Cal.App.4th 1160 and County of Riverside v. McLaughlin 500 U.S. 44 (1991). My son's hearing is tomorrow and if anyone could please help direct me to where, if at all, I can find the answer I would greatly appreciate it. Thank you. Laura
