Legal Question in Criminal Law in California

1364 (a) h&s pos.drg ph, charges (11559 (a) hs

I was at my home in my garage and two plaind clothed officers/detectives came to my house looking for my roommate, she wasn�t home at the time. But then the officer/detective then suspected that I was under the influence and wanted to check my pockets and he then found my meth pipe. They then told me that they were going to take me to the sober tank. They never said I was arrested nor did they read me my rights, and I was released early that morning. I got a ticket at my house 1364 (a) h&s pos.drg ph, and then when I was released I got a promise to appear letter I had to sign with charges (11559 (a) hs. I have court tomorrow the 2nd. I have no charges on my record, 8-9 years ago I had to go to a sober living and I completed all those needed to please the courts. I had been clean and sober from then till now with no charges. Considering I was not out in public to endanger anyone I was on my own property in my house garage. What am I looking at? Thank you Shawn Molskes

You appear to have a lot of issues which need to be addressed. In fact to many to properly answer in this formatt. I strongly suggest you hire an attorney. If the facts you have provided are accurate then you have a very good case. However only an attorney asking you questions will be able to determine your best options. Ask the court for additional time tomorrow to find a attorney. They should grant some extra time. Then find a attorney and do not waste your time trying to do this on your own. If money is an issue then when looking for an attorney be upfront about it. They may work with you.
