Legal Question in Criminal Law in California
417.3 pc Is this considered a strikable offense
My husband pleaded no contest to a misdemeanor pc 417.3 back in 1995. He's pleaded no contest to VC2800.2 (a) in which the prosecuting DA filed as a misdemeanor charge and then bumped it to a felony charge once they couldn't charge him with a possession charge. My question is this, is the PC 417.3 considered a strikable offense under CA's 3 Strikes Law?? I've read all of the sections pertaing to Three Strikes in the CA Penal Code book and do not see it listed there anywhere.

No, it's not a strike. No misdemeanor counts as a strike. At least that's true today. Tomorrow, the people of this state may, in their infinite wisdom, pass new legislation making traffic tickets count as strikes. But for now, you're safe.
