422 pc - first offense
Hi, my brother went to jail for threatening to kill someone. He has no prior crimes and has a clean record. If he pleads not guilty and is convicted of his crime, what kind of sentence is he looking at?

Be careful before you start thinking about what sentence he might get. . .
PC 422 as a felony is also a strike offense under California's 3 strikes law. This crime is a specific intent crime - the DA must prove a certain mental state on your brother's part.
Your brother should be thinking about more than sentence.
