Is it true that a violation of 4324 a PC can be filed as either a misdemeanor or a felony?

I think you mean Business & Professions Code 4234, forging a prescription and yes, it can be charged as either, which means the DA will charge it as a felony. I usually try to get the charge changed to a 11368 so the client can get a PC 1000 diversion or a Prop 36.
