3rd strike or not?

my boy friend is currently facing a petty w/ prior. he has 2 strikes as it stands, not at all theft related. the wittness is allready condradicting himself and its all on record. there are photos of the inccidient, none showing him to have taken anything, AND NO EVIDENCE. as it stands, it's still a fellony. i guess my quest. is should we keep the p.d. or hire private counsel to fight the case to the end?- you know, would that jepordize his chances of misdemeanor(7 months) the cost of crime amounts to approx:$30.00 oh, and how do we prolong this case as far as possible???????

The advantage to hiring an attorney is that you can select the attorney and know who will be present for his trial or other important matters. With the public defender you often do not know who will appear in court with him, and you have no choice in the matter. It is important that both you and he have confidence in the attorney. Also this is a very serious case and demands that you do your best effort be put into defending against the charge. I can make no comment regarding the defenses you may or may not have based on the limited information available.
