Legal Question in Criminal Law in California

3rd Strike?

My Daughter was beaten up severly by her Husband who was out of Prison after 8 yeas on parole. He violated his parole by using Drugs and missing his appointments with his Parole Officer. He was on TV when he was picked up after missing the appointment. He had 2 strikes on him already. Is this considered a 3rd Stike? He is in Prison at DVI. We can't get any information from his Parole agent or any agent. What can we do to find out if he is going to go to trial? We are worried that he is going to be released and come back and possibly kill her! He had two Parole agents; one in Sacramento and one in Santa Rosa and the arrest record of the incident has not been sent to the Man in Santa Rosa. We need help fast.

Re: 3rd Strike?

it does not look like he is going home any time soon. Any third felony can be a third strike, not to mention a violent one. There is no way they are just going to release him.

Prisons keep lists of their inmates on the internet. You might get some information there.

Also, I would keep checking with the DA's Office where your daughter was hurt whether there is any filing on him pending. If there was a full police report made with facts about what he did to your daughter, you bet he is going to have a case.

Good luck,
