Legal Question in Criminal Law in California

My 33 year old brother is in jail for Domestic Violence because he and ex girlfriend got in a argument and he left a small red mark on her arm she has testified that it was not as bad as the d.a. are making it seem that it was a mutal argument and at no time was she affraid or at no time was she hurt and that he has never hit her before, but since there was a red mark on arm and my brother was drunk they arrested him. He has a past record where he got 2 strikes he served his time and got off parole and has got in no trouble over the last 5 years that he's been out, he's not a violent person at all. But if convicted he will get third strike and 25-life in prison. he's taking it to a jury trial but his public defender is not very optimistic that he's gonna win. So I was woundering if there is anything Me and my family can do to help him have a better chance of winning? I know he done wrong but not nothing near worth doing life over. Some murders don't even get that much time so I just don't understand how this can be legal. thanks
