Legal Question in Criminal Law in California
4th ammendment
If my boyfriend was on parole and arrested in my apt. and said that he had drugs in my apt. then they search in bedroom drawers when he didn't even live here. Now they want to give him 4 years and it is going to trial if they supoena me can i take the charge with out them refiling

They can file charges for drug possession. Whether you can have the drugs suppressed would depend on the fact. Contact an attorney to review the facts of you case prior to going to court and claiming the drugs.
