Legal Question in Criminal Law in California

4th time suspended liscence sentence?

My drivers liscence is suspended/revoked due to DUI. I recently got caught driving while my liscence is suspened/revoked. This is my fourth time getting caught for this offense. What is the mandatory jail time I am facing for the fourth offense and will they be taking me to jail directly from the court room as opposed to giving me some time to get my affairs in order before having to turn myself in?

Re: 4th time suspended liscence sentence?

A fourth offense of driving on a suspended license

where the suspension is due to alcohol carries a

mandatory one hundred eightly day minimum sentence.

Sometimes the DA can be persuaded to drop one or

more priors as a way of settling.

Whether the Judge rips you off from the courtroom

of allows you a stay depends on your representation

by your lawyer. I expect stays for my clients and

generally receive them. NOthing is for certain

however as the personality of the judge is the

largest factor.

Obtain competant local legal counsel. No attorney

least of all me can provide accurate legal advice

without studying your case and all its facts.

Good Luck.
