Legal Question in Criminal Law in California
I am currently on 5-year court probation, for "Posession of Stolen Property." I understand that I don't really have any rights, and am subject to "Search and Seizure."
About 2 weeks ago, the police came to my house, and did a "Probation Search" at my house. Which, by the way, was very random. I have not been in any trouble, or given any reason for suspician of any unlawful conduct.
The police officers came about 9:00am, and everyone is still asleep, or just waking up. They made my parents, and my brother all gather in the living room, while they searched the house.
They found nothing. But decided to arrest me anyway, for suspician of being under the influence of a controlled substance. So I was sighted and released after 6 hours.
Three days later, the police show up at my house once again (same cops). They said they were there for a probation search, AGAIN. So, they pull everyone in my house out to the living room, and do another search... They find nothing, again.
This time, the police officer pulls me to the side, and she said that she wants me to "give her some names, of people who are involved in illegal activities (Drug dealers, car theives, etc).
I told her, I just wanted her to leave me and my family alone. We have done nothing wrong.
So she goes to arrest me, AGAIN. She threatened that she would work on taking my son away. So this time, I just didn't want to go through all the hassle of picking up another case, and just didn't want my family to keep having to go through all of this again.
So I told her I would try to help her out, and she let me go.
Basically, she wants me to be a "snitch". Which by the way, is NOT safe, nor do I beleive in making problems for other people, to get myself out of trouble.
The officer, not only wants me to be a snitch, but she wants me to "set someone up", so she can do a bust.
That is totally putting myself in a dangerous situation, and I want nothing to do with it. So I left to a friends house for 4 days. To think about what I should do, or what my options are.
During these 4 days I was away... The police were at my house 3 different times!!
They took my (brand new) digital camera... For "evedence". There is NOTHING on my camera that is illegal, by the way. (Just a bunch of pics of my son, and family).
So, I am now back at home, and I am just scared of what they are going to do next.
* Is there ANYTHING I can do?
* Is it right for them to search my brothers room, when he has never been in trouble, and definately NOT on probatioin?
* Do the police have the right to just walk right into my house, without even knocking?
Any advice would help.

I would advise contacting Internal Affairs and making a complaint. Also regarding the 11550 H&S Code arrest ( under the influence) ..immediately upon release from custody, you should get a private blood or urine test from a private lab to get your own analysis of any drugs in your system, ( assuming you have not done any illegal drugs ).
