Does My 5 year old have to testify?

Is there any law stating that my 5 year old does not have to testify? Also, I got subpeonaed by the DA's Office and Public Defender, for court on the same day and time; is this Legal?

Re: Does My 5 year old have to testify?

Your five year old is probably too young to testify. The judge would speak to the child, and make that determination. If your five year old is mature enough to testify, he's a pretty amazing child. You have been subpoenaed by both the D. A. adn Public Defender. And that's OK.
