Legal Question in Criminal Law in California

my 19 yr old brother troubled by his 17 yr old ex-girlfriend!

My 19yrs old brother is been in jail for 3 nights now because he violated his restraining order by his 17yrs old ex-girlfriend..her father called the police because he went to their house because she threatend to kill herself and but they got into an argument but then not intetionally he punched her in the face and bruised,....he had been very nice and always been, and tried to go to school but after they broke up she started bothering him and he tried to stay away from her and to stay out of trouble....my brother never had any criminal records or history...but now we just found out that he is tested positive of drugs so i guess when he hit her he was on drugs and wasnt to himself....now we still waiting for the judges decision....but dont you think if ever...instead of putting him in jail just put him in rehab or in a program and take anger class pls advice thank you so much!!!

You should retain an attorney to represent you brother, rather than waiting and hoping that the judge will not be harsh on him.

The court often prefers to send someone like your brother to a drug rehab facility, if they want to go.
