How can my friend have his drivers licence took by the court when he was not near his vechile or behind the wheel of of any vechile

A conviction under this section (25662 B&P) triggers a mandatory license suspension regardless of the actual presence / involvement of a motor vehicle. I believe that the constitutionality of that provision is questionable.
