Legal Question in Criminal Law in California
Being accused of a crime in another country
Hi,
I am being accused of a crime from the Philippines though I've never been there and they said they could use chat and email logs against me. How difficult or how easy is it to have a foreign law enforcement agency file charges against an individual from another country? They are accusing me of ''Death Threats'' and ''Pre-meditated Murder'' which did not happen. Both of which they could prove through chat and email logs. Is that possible? What are my legal options?
Thanks.

Any charges would be filed in a Philippine court under Philippine law. Whether they can prove the charges against you with the available evidence is a question of Philippine law, not American law. Whether and how the prosecutor would try to get you extradited is another question, and I'm afraid I don't know the answer.

Charges can be filed against anyone anywhere anytime. Whether the law enforcement in the Philippines can touch you/extradite you from the United States for prosecution there is quite another story. To give you a full answer would require some investigation and research.
You should probably consult with a lawyer here in the United States and Philippines as well. It is impossible to give you a better answer without knowing more details.
