Legal Question in Criminal Law in California
additional violation added to citation
My son was issued a notice to appear citation for curfew violation. However, after the citation was signed & given to my son, another policeman took the citation and added a violation for tobacco. The officer who added the violation did not initial nor did he print his badge number on the citation nor was he the citing officer. Is this legal? Is there legal grounds for requesting dismissal of charges?

You've got a son that is out after curfue and apparently smoking. That's the problem that needs to be worked on.
These small discrepancies will not create such a major deprivation of your son's constitutionally mandated rights to due process as to get the matter dismissed.
