Legal Question in Criminal Law in California

Adult hit my child,now im in jail

Ok i was sitting down eating and this lady who i ahve had problems with starts harrasing me and calling me names, well i walked away with my child to go tell the security guard about the lady, and she comes and starts yelling at me some more and she pulls my childs hair, so i went off cus she touched my child and punched her, now i am in jail,so... what can i do about this? Can i press charges against the other woman? and what would she get for hitting my child(years and stuff like that) thank you so much for enyone who helps.

You need to consult an attorney about your case immediately. If the woman was touching your child and harrassing your child, then you had the right to defend your child from this woman. You will need the assistance of an attorney to fight the criminal charges that were filed against you.

You should also consider obtaining a restraining order against this woman. That would keep her awary from you and your child.

From what you said the most that would be involved for this woman would be a misdemeanor battery. That would limit the sentence to 1 year.

Obtaining the restraining order and keeping this woman away from you is more important than the amount of time she may do in jail for her past conduct.
