Legal Question in Criminal Law in California

Advice before court for Felony Vandalism

My fiancee was arrested for DWI and during the proceedings I was handcuffed and out in the squad car. She was extremely upset and the officers refused to let me talk to her at any time. I eventualy became very upset and kicked the squad door which shattered the window. I am being charged with 594 B1 and drunk in Public. I had only 5 drinks in four hours and was never given a breathalizer. What should I do before court or during?

Get a lawyer. If you can't afford one, the court will appoint one for you. At your first court appearance, don't say anything about what happened unless you already have a lawyer and he or she has advised you to speak.

You should first appear on the date ordered and get the ''discovery.'' That will have the police report. If there's no proof of intoxication, the charge against you for public drunk could be dropped. You'll still have to deal with the vandalism. You should talk to the DA and see what their offer is. You may just have to pay a fine and do some community service, attend AA or anger-management program for a few hours.
