ADW:GBI Sentencing questions

I am being charged with a misdemeanor PC 245(a)(1), FORCE/ADW-NOT FIREARM:GBI. I have only been through the arraignment process at this point and my next hearing is not for another month. Although I'm unsure if this is of any relevance to my question, I am pleading Not Guilty in Self Defense and Defense of others. My question is, what are the minimum and maximum sentences for this charge?

Assualt with a deadly weapon is a felony and can result in prison time. At this point you should be reviewing possible defenses and not what the likely sentence will be in your case. You need to discuss the facts of your case with an attorney and other than an attorney do not discuss the case with anyone, including family members.

If this is your first offense, the misdemeanor charge would carry a sentence of up to one year in the County jail or state prison. The very minimum would be jail time stayed (on hold) with summary probation for two years. If you want more specific detail, please call me. (310) 806-9237
