Under age sex

My cousin had sex with a 14 year old

and he is 19, it was not forced, the

both agreed to it and her mom founf

out be reading her textmessages . He

has no record of any kind..he works

part time and is a full time student.

The mother said that as long as he

moved out they wouldnt call the

cops. He moved out the next day and

now the girl is texting him threatening messages about calling

the cops because she is jealous of

other girls he goes out with...what

can he do and what is the max and

min penalty he can get?

There is, unfortunately not a simple answer to this question. California Penal Code Sec. 261.5(c) makes sex between a 19 year old and a 14 year old punishable against the 19 year old as a misdemeanor or as a felony, (felony punishment under these circumstances is 16 months, 2 or 3 years in the state prison). Sexual conduct with a minor is also punishable pursuant P.C. Sections 287, 288 and other sections.
