Legal Question in Criminal Law in California

Appeal to take back Plea bargain

John Doe took a plea bargain for 35 to life for 2 counts of murder because attorney said it was best instead of trial. John Doe then filed with the court to take back plea bargain. The judge appointed new attourney, heard the case and denied appeal. The new attorney said he would file an appeal, and take it back to court. That was about a year ago. John Doe is in prison and can not contact attourney. I have tried to see what is happening but he does not return my calls. What can John Doe do to get his attourney to contact him on what is happening with his case?

How To Contact An Attorney

Immediately call the State Bar Association in either San Francisco or Los Angeles. Explain to them what you said in your posting to this bulletin board. They will get the lawyer'sattention. You should also go to the Courthouse where theplea occurred and pull the file. You are looking for a "Notice of Appeal" to be in the file. TheClerk will assist you. If it is there, youcan contact the Clerk of the Court of Appeal. TheDistrict and Division will be on the Noticeof Appeal. The Clerk of the Court of Appealwill be able to tell you the status of theappeal.Good Luck
