Legal Question in Criminal Law in California
Appealing a plea bargain...house arrest?
I was tried in court last month on a drug case and accepted a plea bargain of 3 years probation and a 90 day jail term to be served in a weekender program. I am currently 6 1/2 months pregnant and on bed rest as prescribed by my physician. I would like to appeal the 90 days of weekend time to be placed on house arrest. Due to my current medical situation and the hardship of trying to find child care for my 4 minor children, I believe that house arrest would be in the best interest of all. Also, it would allow me to serve all of the time necessary before my child is born.
How probable is it that a judge would accept this appeal?
Also, are there any laws or case studies that I could review that deal specifically to my type of situation?
