Legal Question in Criminal Law in California

Need Help Arranging Court Date

My boyfriend has been incarcerated since 4/24/08 in L.A. County serving 180 days. He missed some court dates out of O.C. County and his probation has been revoked. How does he arrange for a court date for O.C. Court? Cause if he is going to be sentenced he would like for his sentence to run concurrent. He does not want to want to wait until he is released and then has to go thru all the process of being re-booked.

Re: Need Help Arranging Court Date

Normally, there is a hold placed by the other county- in this case, Orange County. When your boyfriend finishes his LA County time, he will be transported to Orange County to deal with his case there. He can't "arrange" for a court date- the time for arranging a court date is past. The Sheriff will now "arrange" a court date for him after he serves his LA time. It is very important not to miss court dates and if a court date is missed, to get to court ASAP afterwards to make sure that there are no warrants- this is one of the reasons.

His lawyer should attempt to reach the disposition on the Orange County case for concurrent time now. It might be possible, especially if the missed court dates were due to his incarceration in LA, although it requires some special dedication, a bit of luck and certainly thinking outside the box.

He should request a pc section 1381 form from the guards. They should provide the form, and after he fills it out sent it to the OC DA. This will place a time limit on there time for action on the case.
