Legal Question in Criminal Law in California
Arrest Report
I am applying for a real estate license in CA, and there is a ? about if one pending cases against them. I am inclined to say no, but was told that the live scan finger prints will alert the DRE that I have a pending case in another state. If case is out of state, will CA DOJ get a hit on the case? I thought my arrest/charges were (for lack of better wording) not available until one was either convicted, or not. HELP! ! ! !

Always be honest with the Department of Real Estate. The Department looks for any reason to deny you a license. If your application does not disclose all information, even if inadvertent, they will generally deny you a license. Further, livescan is a nationwide database system and if a case is pending your arrest and charges will still be in the database.

The best course is to disclose the information the question seeks. You are applying for a California license to allow you to become a fiduciary to your clients. Honesty is the rule of thumb. Good luck.
