Legal Question in Criminal Law in California

Arrested and booked without cause?

On 6/6 I was arrested for drugs. My car was running and my purse was on the front seat of the car. The house was my mothers' who just passed away. He said that he ran my plates and found that I was from another county. This gave him probable cause to search my wallet and purse without asking?

Re: Arrested and booked without cause?

The facts you described don't seem sufficient to justify the officer's search, though with more facts (e.g., if your purse was open and there were drugs in plain view) I might reach a different conclusion. You can move to exclude this evidence as the product of an illegal search; your defense attorney will know how to do this.

Good luck.

Re: Arrested and booked without cause?

From the limited facts you provided there does not seem to be any probable cause for a search nor does there seem to be reasonable suspicion for a detention.
