Legal Question in Criminal Law in California
Can I have someone arrested for embezzlement after the fact?
We had a business partner in an LLC that was dissolved and we took complete ownership. This person remained with the spa and worked as an Esthetitian paying rent. She left a month ago and didn't pay her last months rent. We have also found that customers paid her cash for product and she kept the cash. She also sold gift certificates and kept the cash and now those customers are coming back to us for service. All-in-all she took over $1,400. I have documentation of all this, can I have her arrested for embezzlement or stealing? Do I just call the cops or do I have to go to the DA? Any help would be greatly appreciated, thanks!

Of course you can try to have her arrested after the fact; after all, arrests *always* take place after the crime.
Start by calling the police. They may or may not arrest the suspect, but whether to arrest someone is a decision for the police and whether to prosecute her is a decision for the D.A. She can be prosecuted even the police decide not to arrest her.
