I have been arrested and i this is my first offence for 496d(a) i was o.r. what. Can i do to avoid jail time if posiable.what kind of offer could i get. And will having a petty theft charge from 5 yrs a go affect my chances of staying out of jail?

Unless the value of the property is over $950, you're looking at misdemeanor charges. You *could* face jail, but it depends on the facts, your entire record (the prior theft hurts) and what your lawyer can work out on your behalf.
