Legal Question in Criminal Law in California

assault with a deadly weapon

I was asked to go to PD about a incident that had already been resolved. (Kidnapping my girlfriend)

After discussing this with PD they than asked me about throwing a rock (same incident different charge that I was not aware of) After I admitted that I threw the rock they placed me underarrest and asked me if I wanted my rights read to me and did I want to talk with them further. I said No not without a Lawyer. Did they follow proceedure or did they violate my rights?

Re: assault with a deadly weapon

I would need more details about what happened before I could say whether your rights were violated. Based solely on what you have written I don't see any violation.

As Mr. Stone said, the time to seek legal advice was before you went to the police station, and certainly before you admitted any wrongful conduct. Go get one now; hopefully she will at least be able to minimize the damage you inflicted upon yourself by talking to the police.

Re: assault with a deadly weapon

You should have talked to a lawyer, and demanded a lawyer, before either a) going to the police station or b) admitting you threw a rock.
