Legal Question in Criminal Law in California

Attempt to destroy evidences

My 19 yrs old niece was recently arrested. She had no previous offenses, although she had two traffic tickets unresolved. One she had obtained Community Service and failed to do the Community Serives, the other traffic ticket she had not even showed up in court and she may had had a warrant for her arrest.(Don't know for sure)

When she was arrested, her and boyfriend were smoking pot and additionally my niece threw a meth pipe out the window of the car, i guess right before her arrest. She was charged with attempt to destroy evidences. She was in jail for 2 days waiting for her arraigment.

She is do back in court for her sentencing the begining of November. She has a Public Defender. In your opinion, will she be serving time and more or less how much?

Re: Attempt to destroy evidences

Thank you for your posting.

I think that most attorneys would need much more information to be able to answer your question. You indicated that sentencing is to be in November, but what are the exact charges? Are they violating her for the prior warrant or failure to appear, or a probation violation? Who is the sentencing judge and/or the prosecutor? Has there been a probation report? All of these factors are important in assessing "how much time" a person is looking at, and even then, it's not entirely up to the attorney giving you an opinion.

I hope that this information helps, but if you want more information, have further questions, or feel that you need legal representation, please feel free to email me directly at [email protected]. It's my pleasure to assist you in any way that I can.
